    IT IS ORDERED THAT:–

    1.  The Claimant be permitted to rely on the evidence of Zoe Polanska-Palmer and Germar Rudolf Scheerer at the hearing of the Claimant’s application for permission to appeal, subject to producing Zoe Polanska-Palmer and Germar Rudolf Scheerer for cross-examination.

    2.  The costs of this application be reserved to the court hearing the Claimant’s application for permission to appeal.
