13.164 I have already set out at paragraphs 4.7 to 4.9 above the test which is to be applied when deciding the fate of the plea of justification, namely whether the Defendants have established to the appropriate standard that the imputations published about Irving are, in the meanings which I have found them to bear, substantially justified. As I have pointed out, the Defendants are entitled, if and to the extent that may be necessary, to take advantage of the provisions of section 5 of the Defamation Act 1952.
